1. About these terms
These Terms of Use (“Terms”) apply to the Vervo app and this website (together, the “Service”). The Service is provided by Maksymilian Mogilski (“we”, “us”). By downloading or using Vervo, you agree to these Terms. If you don't agree, please don't use the Service.
Our Privacy Policy explains how we handle your data and forms part of these Terms.
2. What Vervo is
Vervo helps you practice impromptu speaking. You draw a random topic, speak for up to a minute, and get automatically generated feedback on your answer. Vervo is a self-practice tool for general educational purposes. It is not professional coaching, psychological or medical treatment, or career, legal or any other professional advice.
3. Who can use Vervo
You must be at least 16 years old, or the minimum age required in your country, to use the Service. By using it, you confirm that you meet this requirement.
4. Subscriptions and payments
- Access to Vervo requires a paid subscription, bought through Apple's App Store.
- Prices and subscription periods are shown in the app before you buy.
- Subscriptions renew automatically unless you turn off auto-renewal at least 24 hours before the end of the current period. You can manage or cancel your subscription in your Apple ID settings.
- Payments, refunds and any free trials are handled by Apple under its terms. We can't issue refunds directly.
5. AI-generated feedback
Feedback in Vervo, including scores, notes, suggestions and example sentences, is generated automatically by third-party artificial intelligence models. It is not written or reviewed by a person.
You understand and agree that:
- AI feedback may be inaccurate, incomplete, inconsistent, out of context or otherwise unsuitable for you, and scores are rough indicators, not objective measurements of your skills;
- feedback is provided for practice only and is not professional advice of any kind;
- you alone decide whether and how to use any feedback, and you are solely responsible for that use and its consequences, for example in job interviews, presentations, exams or other real situations;
- to the fullest extent permitted by law, we are not responsible for the content of AI-generated feedback or for any decisions, actions or outcomes resulting from its use.
6. Your content
What you say in the app stays yours. You give us a limited, non-exclusive permission to process the transcript of your answers only to provide the Service, as described in our Privacy Policy.
Please don't include sensitive personal information about yourself or other people in your answers. You are responsible for what you say in the app.
7. Acceptable use
You agree not to:
- use the Service for anything unlawful, harmful or abusive;
- try to get around usage limits, access controls or the subscription;
- reverse engineer, copy, resell or misuse the app, its content or our servers;
- use automated means to access the Service or overload it.
We may suspend or end access for anyone who breaks these rules.
8. Intellectual property
The app, its design, the Vervo name and logo, topics and other content we provide belong to us or our licensors. We give you a personal, non-transferable licence to use the app on Apple devices you own or control, for your own non-commercial use, in line with these Terms and the App Store rules.
9. Availability and changes
We work to keep Vervo running smoothly, but we don't guarantee that it will always be available, uninterrupted or error-free. We may change, add or remove features, including AI models and daily limits, at any time.
10. Disclaimer
To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose. We don't promise any specific result from using Vervo, such as better speaking skills, a job offer or exam success.
11. Limitation of liability
To the fullest extent permitted by law:
- we are not liable for any indirect, incidental, special or consequential damages, or for any loss of profits, opportunities, data or reputation, arising from your use of the Service or of AI-generated feedback;
- our total liability for any claim related to the Service is limited to the amount you paid for Vervo in the 12 months before the claim.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including liability for intentional misconduct, or your statutory rights as a consumer.
12. Ending your use
You can stop using Vervo at any time by cancelling your subscription and deleting the app. To have your data deleted, see our Privacy Policy.
13. Apple
These Terms are between you and us, not Apple. Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support for it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Where these Terms don't cover something, Apple's Standard End User License Agreement applies.
14. Changes to these terms
We may update these Terms from time to time. We'll change the “Last updated” date above and, for significant changes, let you know in the app. If you keep using Vervo after the changes take effect, you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of Poland. If you are a consumer, you also keep the protection of any mandatory laws of the country where you live, and you may bring claims in the courts there.
